Conditions of use and privacy policy

This document provides the Conditions of Use and Privacy Policy as set forth by Cirrus Software for Engineering SAC (hereinafter called “Inty360”) for your Inty360 Catch&Rep software, and applies to the Inty360 Catch&Rep Web, Mobile and Desktop components.

1. COLLECTED INFORMATION

a. Registration
To create an Inty360 Catch&Rep account, you must at least provide your name, e-mail address and password, and accept our Conditions of Use and Privacy Policy that govern the manner in which we treat your information. We can also request your credit card information if you subscribe to paid services provided by Inty360 Catch&Rep.

b. Profile Information
During the registration process, you must provide the following additional information: date of birth, tell us if you are man or a woman, country of residence, and select a category and sector of your economic activity. Additionally, if you wish, you can also provide the state or province where you live, as well as city and postal code. Providing us the name of the place where you work or study is also optional.
The purpose of collecting this information it to provide you with more personalized services. You understand that by creating an account, we, as well as third parties, will be able to identify you through your user profile.

c. Sharing form formats
If you have a valid Free subscription plan from Inty360 Catch&Rep, you accept to share the format of the forms you have created with all Inty360 Catch&Rep users. Under no circumstance is owned information shared without previous authorization, and it is only shared with those specific users that you determine.

d. Customer Service
When you contact our customer service (Support), we may have to access your account and collect information needed to categorize your inquiry, answer it and, if applicable, investigate any breach to our Conditions of Use and Privacy Policy. We also use such information to follow up on potential problems or tendencies, and personalize our answers with the purpose of serving you better. We will not use this information for advertising purposes.

e. Use of services from third parties
You give us permission to receive information when using your account to login to the web site or through a third party application. We will use this information to personalize the function that we provide in third party web sites.
You also give us permission to receive information about your visits and interactions with web sites and services from our partners that include our cookies and similar technologies.

f. Others
Our Services make up a dynamic and innovative environment, which implies that we are always searching for ways of improving the services we offer you. We regularly incorporate new features, some of which may require the collection of new information. In addition, new partnerships or corporate acquisitions may lead to new features, and we may collect other type of information. In case we begin to collect new types of personal information in a significant way, as well as materially change the manner in which we manage your data, we will modify this Privacy Policy and notify you.

2. USE

a. Consent to the treatment of information
Upon providing us your personal information when you create or update your account and your profile, you are explicitly and voluntarily accepting the terms and conditions of our Conditions of Use, and you freely accept and consent that we process your personal information in the ways established by this Privacy Policy. If you provide us personal information that is considered “sensitive” by the relevant legislation, it constitutes and entirely voluntary act. You may withdraw or modify your consent regarding the collection and treatment of the information you provide, at any given moment, in accordance with the terms of this Privacy Policy and the Conditions of Use, by closing your accounts with Inty360 Catch&Rep.

b. Communications with Inty360 Catch&Rep
We communicate with you through e-mail messages, news published in the Inty360 Catch&Rep web sites or applications, messages dropped in your inbox and other means available through our services, including text messages in mobile devices and automatic notifications. Among some examples of these communications, the following are worth mentioning: (1) welcome and participation communications: to inform you about the best ways to use our Services, new features and updates, etc.; (2) communications about the service: these encompass the service availability, security and other matters regarding the performance of our services; (3) promotional messages: these include e-mail messages, and may include promotional information coming directly from us or on behalf of our partners, including business opportunities and information from companies that are recruiting.

c. Service development
We use information that you and other members provide to perform research studies and develop web sites in order to improve our services. This is done with the aim of granting you, other Members and Visitors a better and more intuitive experience, increasing the number of members and participation in our services, as well as helping professionals that seek service improvements.

We use information from members for invitations and messages that promote our services.

d. Compliance with a court order
We may have to disclose your personal information, profile information or information about your activities as Member or Visitor, when it is required by law, through a summons or any other court order, be it in the United States or another jurisdiction, or if we believe, in good faith, that the disclosure is reasonably necessary for the following: (1) investigate, prevent or act in regard to suspected or confirmed illegal activities, or to help state law enforcement entities; (2) to enforce the Conditions of Use, investigate or develop a defense against claims or third-party allegations, or to protect the security or integrity of our Services; or (3) to exercise or protect the rights, the property or the safety of Inty360, or of our Members, employees, among others. We will try to notify our Members that his or her personal information has been legally requested when we consider it necessary, to the best of our judgment, unless the law or a court order forbids it, or when the request is urgent. Under our principles, we may question such requirements when we consider, to the best of our understanding, that the requests are too broad, vague or lack the necessary authority, although we do not commit to contest each petition.

e. Service providers
We may contract the services of third-party companies and individuals to provide our Services (for instance, maintenance, analysis, auditing, marketing and development tasks). These third parties will have limited access to your information, with the sole purpose of executing these tasks on our behalf, and are required by Inty360 to refrain from disclosing or using it for other purposes.

f. Data processing outside the country
We may transfer your information and process it outside your country of residence, where Inty360, its subsidiary companies or its service providers operate.

g. Mobile devices and other services
We offer our services for mobile devices, free of charge; however, keep in mind that your operator will apply its normal fees, such as data usage fees.
You consent and grant the necessary rights to allow the users to synchronize (even through an application) their devices with any information they can view in Inty360 Catch&Rep.

3. OBLIGATIONS

a. Rights of access, edition or deletion of your information, and closure of your account
You have the right to (1) access, modify, correct or delete your personal information that is controlled by Inty360 regarding your profile; (2) change or delete your contents; and (3) close your account. If you close your account, your information will be deleted within a time frame no longer than 24 hours.

b. Data retention
We will retain personal information that you provide us while your account remains active or as long as it is necessary to provide services to you. We may retain the personal information of our Members during a limited period of time, in order to comply with the law. Our Costumer Service unit may retain information as long as it is needed in order to provide you with help information.

c. Service payment
If you purchase one of our paid subscription Plans, you accept to pay us the relevant fees and taxes. Failure to pay these fees may lead to the finalization of your subscription. Your purchase may be subject to exchange rates or differences in pricing depending on your location (exchange rates, for instance).

d. Notifications and messages about services
You accept that we contact you in the following ways: (1) a notice in the form of a banner in the Service, or (2) an email message sent to an address that you provide to us, or (3) through other means including a mobile phone number, land line or postal address. You agree to maintain your contact information up to date.

4. IMPORTANT INFORMATION

a. Modifications to the Privacy Policy
We may modify this Privacy Policy from time to time. If we make relevant changes regarding the manner in which we treat your personal information, or to the Privacy Policy, we will notify you through our Services or by other means, such as e-mail communication. Please review the changes closely. If you agree to the changes, simply continue using our Services. If you have any objections to the changes introduced to the terms, and you do not wish to continue using our Services, you may close your account(s). Unless stated otherwise, our current Privacy Policy applies to all the information we have about you and your account. If you use our Services after having received a notification of changes or after it has been published in our Services, it will be understood that you agree to the modified terms or practices.

b. Security
We have introduced security systems designed to protect the personal information that you provide according to the standards of the industry. Access to your data in our Services is protected through a password. Regarding the protection of the data that you store in our servers, we also periodically audit our system in order to detect possible vulnerabilities and attacks. Nevertheless, since the Internet is not a completely safe environment, we cannot assure or guarantee the safety of all the information that you transmit to us. There is no guarantee that the information is not subject to being obtained, disclosed, altered or destroyed, violating one of our physical, technical or management security measures. You are responsible for protecting the safety of your access information. Bear in mind that e-mails, instant messages and other similar means of communication are not encrypted, so we strongly encourage you to refrain from sharing confidential information through them. Help maintain the security of your account by using a strong password.
